Your response: I think there is a small grey area when both people are too intoxicated or on other drugs which cause them to be unable to give consent or realize that the other person cannot give consent. However, in most cases, there is no grey area.

Your response: both drunk, then it comes down to if a person feels traumatized.

Your response: Alcohol... if the victim was black out drunk, how does he or she know if they consented at that time, since they do not remember. What if the person committing the assault did not know the other person was black out, inebriated, impaired, etc.
