However I do have a question for you.
If a couple of U.S.citzens travel over seas and there kid is born on foreign soil.Is the child a U.S. citzen???

SUBJECT: U.S. Governments Legal Authority To Destroy An American Citizens Family.

My name is Chris, I am 39 yrs, and living in Auburn, Wa.

Nine years ago I married my wife Estella Guzman. She is from a state in Mexico called Michoachan. When I began dating her, she spoke very little English, and I very little Spanish. The subject of her status here in the U.S. really did not rise until approx 6 months into our relationship. Being an American myself (born and raised on Whidbey Island) I did not fully realize the difficulty of "legalizing" her. About 2 years after being married, while discussing the latest I.N.S. form and fee, Estella told me her story of crossing the border. She traveled from Michoachan with an Uncle to TiaJuana, where he then gave her a fake green card and let her out of the car to walk thru the pedestrian crossing...well needless to say our border guards may or may not be a lot of things, but they are highly trained to spot fake green cards. Estella was stopped, questioned and turned back. In Border Patrol language "deported". She returned to the border and successfully crossed two days later.

We have had two boys since we've been married, Aaron 7 years, and Joshua 4 years. We've gone through all the I.N.S. paperwork there is to go through, and when finished with I.N.S. they forwarded her case to the National Visa Center in N.H. for a Visa interview appointment. We received notice of that appointment in Oct of 05. The date was set for Nov 10th of 2005. We packed up the kids and drove to El Paso Texas, then crossed the border into Cuidad Juarez. My wife was required to have a medical exam the day before the interview which she did. The fee should have been only $150, however the clinic told her she would need to receive two vaccinations for her travel into the U.S. Cost? $300. The following day I let her go at the door of the consulate (for some reason they don't allow Americans into the American Consulate unless you pay the Mexican Security Guard twenty-five dollars...which I found out later) and waited back at the hotel. Estella appeared at about five oclock completely devestated. Through her crying I came to understand that her case had been denied, and she would not be allowed to re-apply for ten years (ten year bar). Shock is the right first word, anger is the second. I returned a single dad of two little boys to Washington state, my family destroyed.

. I am an eight year Veteran of the U.S. Army, so I wrote a letter and sent it to many Senators and Congresspersons titled ,"How could this happen to a Veteran?"

I received a letter from Vice President Cheney stating that his office would contact Homeland Security and have them explain directly to me their reasons for my family loss. Homeland Security stated that they HAD ALREADY approved my petition and forwarded it on to the next link in the chain which is the Visa Center in New Hampshire. However contacting them did no good, they immediately pased the buck to the poorly run Consulate at Cuidad Juarez. I have sent correspondence to that location, but received no reply.

Section 212 INS states that any person having been deported and then returns undocumented to U.S. soil, and stays for a period of more than six months is barred from any application for Visa for a period of no less than ten years.
Probably ninety-five percent of aliens from Mexico are married to other Mexicans whether legal or not, I believe this is what lawmakers had in mind while working with section 212. If a spouse of an illegal, green card holder, or temp visa alien is barred from re-entry for ten years, chances are the entire family will return with that spouse to their homeland and pick up where they left off. What about us American spouses? Whidbey Island isn't exactly boot camp for moving to Mexico.

If it is legal for the pinheads at the American Consulate in Cuidad Juarez to destroy an American Citizens family, then why was I allowed in the first place to be married legally in the State of Washington with no check of my wifes status whatsoever. Had I known that my two boys and I would be separated for such an ungodly length of time perhaps I may not have chosen to marry Estella. I would submit that because of this oversight and the fact that an everyday American citizen cannot be expected to fully understand immigration law fully without training or guidance whatsoever, it is not lawful to pose the sanctions of Section 212 on aliens married to U.S. Citizens (felony criminal convictions excluded of course).

If the lawmakers had in mind to slow marriage fraud in order to gain citizenship, then why are their no stipulations such as "marriage for five or more years, or marriage with one or more children are exempt of section 212, or allowed waivers. I tried to stress the point of ammending this law to the officials I previously mentioned, and I don't think my point was made. I would like to know if you might have any information on what it might take to solve this disaster for not only myself, but hundreds perhaps thousands of other Americans going through this devastating situation. I am reminded of a quote spoken during our marriage ceremony "What God has drawn together, let no man put assunder."
